Appeal, from the disallowance by a commissioner appointed by the Probate Court of a claim against the estate of an intestate decedent. The claim is based on an oral contract found by a jury in the Superior Court fully performed by the plaintiff and made in the following terms: "If you [the plaintiff] will stay here with me for a while until I [the decedent] get back on my feet and stay in Rochester and be near me whenever I need you youll never be sorry for this, for some day everything I have will be yours when Im gone." The decedent left an estate consisting of real estate appraised at $3,500 and personal property appraised at over $19,000.
